General Terms and Conditions of Mapaqatix B2B e-shop

These terms and conditions govern the purchase of goods through our B2B e-shop and apply exclusively to business relationships between us as the seller and entrepreneurs as buyers. By submitting an order, the buyer confirms that he is acting within the scope of his business activities and is purchasing for the purposes of resale, distribution or professional use.

2. Who is the B2B e-shop intended for?

The B2B e-shop is intended exclusively for entrepreneurs, especially swimming schools, distributors, business partners, specialized stores, sports clubs, swimming pools and other professional entities. We reserve the right to not approve registration or order if the interested party does not meet the conditions of B2B cooperation.

3. Purchase Contract

The presentation of goods on the website is for informational purposes only and does not constitute a binding offer to contract. A purchase contract is only concluded upon confirmation of the order by us. Automatic confirmation of receipt of the order is not considered acceptance of the offer, unless expressly stated otherwise.

4. Prices

All prices are exclusive of VAT, unless otherwise stated. VAT, shipping, packaging and other related costs may be added to the price depending on the nature of the order and the place of delivery. The price confirmed at the time of order acceptance is always valid.

5. Payment terms

Payment is made by invoice, advance invoice, bank transfer or other pre-agreed method. Unless otherwise agreed, the invoice is due within 14 days. We reserve the right to request payment in advance, especially for new partners, foreign orders, larger volumes or custom production.

6. Delivery terms

Delivery dates are given for guidance only, unless expressly agreed otherwise. The goods are considered delivered upon handover to the carrier or upon receipt by the buyer, depending on the chosen delivery method. The buyer is obliged to check the shipment upon receipt and to report any obvious defects without undue delay.

7. Complaints

The buyer is obliged to check the goods after receipt, especially in terms of quantity, type, size and obvious defects. Obvious defects must be reported in writing no later than 5 working days from receipt. Hidden defects without undue delay after their discovery.

In the event of a justified complaint, we will provide, depending on the nature of the matter, an exchange of goods, completion of the missing performance, a discount or other appropriate solution.

8. Returns

The buyer acknowledges that as an entrepreneur he does not have the right to withdraw from the contract without giving a reason within the consumer period. Return of faultless goods is only possible based on a prior individual agreement. Custom-made, branded, printed or otherwise individualized goods cannot be returned unless otherwise agreed in writing.

9. Product information and responsibility for use

The buyer is responsible for further offering, selling and using the goods in accordance with their intended use, technical parameters and manufacturer’s recommendations. For products for infants, children and swimming facilities, the buyer is obliged to ensure proper storage, hygienic handling and provision of accurate information to its customers.

10. Intellectual property

All texts, photographs, product materials, graphics, brand and other content of the website are protected by intellectual property rights. These materials may not be copied, modified or used beyond the scope of normal support for the sale of original goods without our prior written consent.

11. Distribution and exclusivity

Neither registration in the B2B e-shop nor the purchase itself creates a right to exclusive distribution, exclusivity or commercial representation. Any exclusive commercial cooperation must be regulated by a separate written contract.

12. Protection of personal data

We process personal data to the extent necessary for registration, orders, delivery of goods, invoicing and business communication. Details on the processing of personal data are provided in the Personal Data Processing Policy.

13. Final provisions

These terms and conditions are governed by the law of the Czech Republic. Any disputes will be resolved primarily by agreement; if agreement is not possible, the competent courts of the Czech Republic will decide. We reserve the right to update these terms and conditions accordingly. For already confirmed orders, the wording effective at the time of conclusion of the contract always applies.

These terms and conditions come into effect on 1.4.2026.
